Hey sup! So the Supreme Court dropped a whole lotta cases last week, including two cases around the intersection of religion and employment law. We discuss those cases in depth. And we have...opinions. The first is Our Lady of Guadalupe School v. Morrissey-Berru, which effective expands the "Ministerial Exception" and says that religious organizations can discriminate against any employee with a religious or "ministerial" role. The second is Little Sisters of the Poor Saints Peter and Paul Home v. Pennsylvania, which says employers can opt out of providing birth control and contraception under health benefit plans based on religious or moral grounds. The verdict is in on Tavis Smiley! Mr. Smiley was suspended and fired in 2017 as a former PBS host at the height of #MeToo, accused of having sexual relations -- some consensual, some not -- with co-workers, including subordinates. He sued PBS, who counter-sued based on a morals clause in his contract. In their first special episode, Marc and Kate discuss the case and the jury verdict that came down in early March 2020.
